Letter of Demand
Letter of Demand
Fair Work Act 2009 (Cth) 323 (1)(c)

RE: Letter of Demand – Outstanding Wages and Entitlements – [Your Name]
Dear [Name of Manager/Owner],
I am writing to you regarding the underpayment of my wages and entitlements for the period of employment from [Start Date] to [End Date].
Based on the [Insert Award Name, e.g., Restaurant Industry Award 2020] and the Fair Work Act 2009, I am entitled to be paid at the correct classification rate for all hours worked, including penalty rates and allowances.
However, a review of my records indicates that I have been underpaid a total amount of $[To mount]. This amount is calculated as follows:
- Underpayment of Ordinary Hours: $[Amount]
- Reference: Clause X of the Award relating to minimum wages.
- Unpaid Penalty Rates (Weekend/Public Holiday): $[Amount]
- Reference: Clause X of the Award.
- Payment in lieu of notice: $[Amount] (if applicable)
- Reference: Section 117 of the Fair Work Act 2009.
- Accrued Annual Leave: $[Amount]
- Reference: Section 90(2) of the Fair Work Act 2009.
Total Outstanding Amount: $[Total Amount]
Attached is a detailed breakdown of these calculations for your reference.
According to Section 323 of the Fair Work Act 2009, an employer must pay an employee amounts payable to the employee in full. Failure to do so is a contravention of a civil remedy provision.
I request that this total amount be paid into my bank account within 7 days from the date of this letter (i.e., by [Date]).
Bank Details: Account Name: [Your Name] BSB: [Your BSB] Account Number: [Your Account No]
If I do not receive payment or a satisfactory response by this date, I reserve the right to take further legal action to recover these monies, including lodging a claim with the Fair Work Ombudsman or the Small Claims Division of the [State/Territory] Courts, without further notice. In such proceedings, I may also seek interest on the outstanding amount and the imposition of pecuniary penalties for contraventions of the Fair Work Act 2009.
I hope we can resolve this matter amicably and promptly.
Yours sincerely,
